1. Acceptance of these Terms
These Terms of Use ("Terms") govern your access to and use of the Exchange Stickers / Troca Figurinhas mobile application, website, features, content, and related services (collectively, the "App"), provided by King Apps ("King", "King Apps", "we", "our", or "us").
By downloading, accessing, creating an account, posting content, contacting other users, or otherwise using the App, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
If you use the App on behalf of another person or entity, you represent that you have authority to accept these Terms on their behalf.
2. About the App
The App helps users organize sticker collections and find other users who may want to exchange stickers. The App is a technology platform only. King Apps is not a party to any agreement, meeting, conversation, shipment, payment, donation, purchase, sale, or exchange made between users.
We do not own, verify, authenticate, inspect, insure, guarantee, sell, buy, ship, store, or physically handle stickers or other items offered by users. Any exchange is made at your own risk and is solely your responsibility.
The App is not affiliated with, endorsed by, sponsored by, or officially connected to any sticker album publisher, sports organization, event organizer, league, team, brand, athlete, celebrity, tournament, or intellectual property owner unless expressly stated by King Apps in writing.
3. Eligibility and account responsibility
3.1 You must be legally permitted to use the App in your jurisdiction. If you are under the age required by applicable law to accept these Terms, you may use the App only with the consent and supervision of a parent or legal guardian.
3.2 You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account, and for all activity under your account.
3.3 You may not impersonate another person, misrepresent your identity, create accounts using false information, or use another user's account without permission.
3.4 We may refuse, suspend, restrict, or terminate access to the App if we believe your use violates these Terms, creates risk, may harm users, or may expose King Apps or third parties to liability.
4. User-generated content and zero tolerance policy
The App may allow users to create, upload, share, list, send, or display content, including profile information, sticker lists, messages, images, usernames, location-related information, and other materials ("User Content").
We have zero tolerance for objectionable content or abusive users. You may not create, upload, share, send, request, encourage, or distribute User Content or behavior that is illegal, harmful, abusive, harassing, hateful, discriminatory, threatening, sexually explicit, pornographic, violent, exploitative, defamatory, fraudulent, deceptive, invasive of privacy, spam, malware, or otherwise objectionable.
You may not post or exchange content that facilitates child sexual exploitation or abuse, grooming, sexualization of minors, trafficking, terrorism, self-harm, illegal goods or services, scams, identity theft, or any conduct that violates applicable laws or platform policies.
You are solely responsible for your User Content and interactions. King Apps does not endorse User Content and is not responsible for the accuracy, legality, safety, quality, or availability of User Content or user exchanges.
5. Reporting, blocking, moderation, and enforcement
5.1 The App may provide tools to report content, report users, block users, restrict contact, or otherwise reduce unwanted interactions. You agree to use these tools responsibly.
5.2 You may also report safety concerns, objectionable content, abuse, intellectual property concerns, privacy issues, or other violations by contacting us at contato@king.app.br.
5.3 We may review, remove, restrict, hide, disable, or preserve User Content, accounts, listings, or messages at our discretion, including when required by law, platform policy, user safety, fraud prevention, or protection of King Apps and third parties.
5.4 We may suspend or ban users who violate these Terms, repeatedly receive valid reports, attempt to bypass moderation, abuse other users, or create safety, legal, operational, or reputational risk.
5.5 We do not guarantee that all objectionable content will be detected or removed immediately. You should use caution when interacting with other users.
6. Safe exchanges and user interactions
6.1 You are solely responsible for deciding whether, when, where, and how to interact with another user. Do not share sensitive personal information, financial information, passwords, verification codes, or private documents with other users.
6.2 If you decide to meet another user, do so only in a safe public place, preferably accompanied by a trusted adult or person. Minors must not meet other users without appropriate parental or guardian supervision.
6.3 King Apps is not responsible for lost, damaged, counterfeit, incomplete, delayed, unpaid, stolen, or misrepresented stickers or items, or for any disagreement, injury, loss, claim, damage, or dispute arising from user interactions.
6.4 You may not use the App to harass, pressure, threaten, stalk, dox, extort, blackmail, or otherwise harm another person.
7. Prohibited use
You agree not to:
7.1 violate any law, regulation, third-party right, platform policy, or these Terms;
7.2 sell, advertise, or exchange illegal, stolen, counterfeit, restricted, unsafe, or unauthorized goods;
7.3 use the App for spam, phishing, scams, pyramid schemes, fraud, deceptive practices, or unauthorized commercial solicitation;
7.4 collect, scrape, index, copy, harvest, or misuse data from the App or its users;
7.5 interfere with the App's operation, security, servers, networks, moderation systems, or access controls;
7.6 reverse engineer, decompile, modify, copy, resell, sublicense, or create derivative works from the App except where prohibited by law;
7.7 upload viruses, malicious code, automated scripts, bots, or any technology intended to disrupt, manipulate, or overload the App.
8. Intellectual property
8.1 The App, including its software, design, features, interface, trademarks, logos, text, and other materials created by King Apps, is owned by King Apps or its licensors and is protected by intellectual property laws.
8.2 Subject to these Terms, King Apps grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App for its intended purpose.
8.3 You retain ownership of your User Content. By submitting User Content, you grant King Apps a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, process, moderate, remove, translate, and use that User Content only as needed to operate, improve, protect, and provide the App.
8.4 You represent that you have all rights necessary to submit your User Content and that your User Content does not violate third-party rights.
8.5 Sticker names, album names, images, team names, event names, logos, brands, and other third-party materials may be protected by their respective owners. Their appearance in user content or descriptive references does not imply ownership, sponsorship, approval, endorsement, or partnership by King Apps.
9. Purchases, subscriptions, and payments
The App may offer paid features, subscriptions, or in-app purchases. Payments made through Apple App Store or Google Play are processed by the applicable store and are subject to that store's terms, rules, billing policies, refund policies, and subscription management procedures.
King Apps does not control Apple or Google billing systems and is not responsible for store payment processing errors, chargebacks, taxes collected by stores, or refund decisions made by Apple or Google. Where required by applicable law, nothing in these Terms limits your statutory consumer rights.
You may not avoid, bypass, manipulate, or misuse payment systems, promotional offers, subscriptions, trials, or in-app purchase mechanisms.
10. Privacy, data, and location
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information. You agree that King Apps may process information as described in the Privacy Policy and as necessary to provide, protect, moderate, and improve the App.
Some features may use approximate or precise location, contact information, device information, analytics, crash logs, or other data, only as permitted by applicable law, platform requirements, and your permissions. You are responsible for the information you choose to share with other users.
11. Apple-specific terms
If you downloaded or use the App on an Apple-branded product:
11.1 These Terms are between you and King Apps only, not Apple. King Apps, not Apple, is solely responsible for the App and its content.
11.2 Your license to use the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume purchasing rules.
11.3 Apple has no obligation to provide maintenance or support services for the App.
11.4 To the extent any warranty applies and is not effectively disclaimed, Apple may be responsible only for refunding the purchase price for the App, if any, as required by Apple's applicable terms. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
11.5 Apple is not responsible for addressing any claims relating to the App or your use of the App, including product liability claims, legal or regulatory claims, or consumer protection claims.
11.6 In the event of a third-party claim that the App or your possession and use of the App infringes intellectual property rights, King Apps, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim to the extent required by these Terms and applicable law.
11.7 Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
12. Third-party services and app stores
The App may interact with third-party services, including Apple, Google, analytics providers, hosting providers, communication tools, advertising partners, payment processors, or external websites. Third-party services are governed by their own terms and privacy policies.
King Apps is not responsible for third-party services, third-party content, store policies, service interruptions, availability, errors, acts, omissions, or damages caused by third parties.
13. Disclaimers
The App is provided "as is" and "as available." To the maximum extent permitted by law, King Apps disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, uninterrupted operation, and error-free operation.
We do not guarantee that the App will meet your expectations, that users will complete exchanges, that any sticker or item is authentic or available, that user information is accurate, or that the App will be free from harmful content, misuse, defects, interruptions, or unauthorized access.
14. Limitation of liability
To the maximum extent permitted by law, King Apps, its owners, directors, officers, employees, contractors, affiliates, licensors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, personal injury, property damage, business interruption, or damages arising from user interactions, exchanges, meetings, shipments, payments, content, or third-party services.
To the maximum extent permitted by law, King Apps' total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of: (a) the amount you paid directly to King Apps for the App during the twelve months before the event giving rise to the claim; or (b) USD 50.
15. Indemnification
You agree to defend, indemnify, and hold harmless King Apps, its owners, directors, officers, employees, contractors, affiliates, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your use of the App; your User Content; your interactions or exchanges with other users; your violation of these Terms; your violation of law; or your infringement or violation of third-party rights.
16. Changes, suspension, and termination
We may update these Terms from time to time. The updated version will be effective when posted or otherwise made available through the App or our website, unless a later date is stated.
We may change, suspend, discontinue, restrict, or remove any part of the App at any time, with or without notice, including features, listings, content, accounts, or availability in certain regions.
You may stop using the App at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions.
17. Governing law and disputes
These Terms are governed by the laws of Brazil, without regard to conflict of law rules, except where mandatory consumer protection laws in your country provide otherwise.
To the maximum extent permitted by law, any dispute arising out of or relating to these Terms or the App will be submitted to the courts of Curitiba, State of Parana, Brazil. Nothing in these Terms prevents King Apps from seeking injunctive or equitable relief in any jurisdiction to protect its rights, users, systems, or the App.
